These Terms and Conditions (“Terms”) govern your access to and use of luposbaseball.com (the “Site”), all content, services, digital products, memberships, giveaways, video evaluations, private coaching sessions, and any other offerings provided by Lupos Baseball LLC (“we,” “us,” or “our”).

By accessing the Site, purchasing any product or service, subscribing to our membership, or using any free or paid resources, you agree to these Terms. If you do not agree, do not use the Site or our services.

1. Eligibility You must be at least 13 years of age to use the Site. The Site and services are intended for middle school, high school, and college baseball players and their families. If you are under 18, You must have permission from a parent or legal guardian.

2. Services and Products Our offerings currently focus on hitting instruction and include:

  • Free giveaways (PDF guides, resources, newsletters)

  • Monthly membership ($9.99/month) with access to the Sabermetric Calculator (performance tracker for baseball stats and workouts), member resources, and exclusive content

  • Video evaluations: Submit hitting videos for personalized feedback and tips delivered via annotated video format

  • Private coaching sessions: Live remote one-on-one hitting instruction

All content is for informational and educational purposes only. It is not medical advice, physical therapy, or professional athletic training. Always consult a physician before attempting any drill, exercise, or training program. The Site and all services are provided “as is” for informational purposes only. Use at your own risk.

3. Payments and Billing

  • All prices are in USD and subject to change at any time without notice.

  • Memberships are recurring and auto-renew monthly until canceled. You may cancel anytime via your account—no refunds for partial months.

  • One-time services (video evaluations, coaching sessions) are non-refundable once booked, scheduled, or delivered.

  • Promotional pricing, introductory offers, free months, or discounts are valid only for the specified period and do not continue after expiration or any service interruption.

  • Payments are processed securely via third-party providers (e.g., Stripe). We do not store full credit card details.

4. Intellectual Property and Copyright All content on the Site, including videos, PDF guides, Sabermetric Calculator, written materials, drills, graphics, logos, and any other materials provided through memberships, giveaways, evaluations, or coaching sessions (collectively, the “Content”) is owned by Lupos Baseball LLC or licensed to us and protected by United States copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your personal, non-commercial training and development purposes during the term of your membership or service purchase. You may not:

  • Copy, reproduce, distribute, modify, create derivative works from, publicly display, or perform the Content

  • Use the Content for any commercial purpose or to create competing products/services

  • Share login credentials, member-only Content, or evaluation videos with non-members

  • Remove or alter any copyright, trademark, or proprietary notices

By submitting hitting videos, you grant us a non-exclusive, royalty-free license to use, edit, and display the video solely for the purpose of providing your evaluation and coaching feedback. Any unauthorized use terminates your license immediately and may result in legal action. All rights not expressly granted are reserved.

5. User Conduct You agree not to:

  • Share login credentials or member content with non-members

  • Upload inappropriate, harmful, or infringing material

  • Use the Site or services for unlawful purposes

  • Harass, abuse, or interfere with other users or our staff

Violation may result in immediate termination of access without refund.

6. Cancellations and Refunds

  • Digital products and giveaways are non-refundable once delivered.

  • Memberships: Cancel anytime; access continues until the end of the current billing period.

  • Services: No refunds for completed video evaluations or coaching sessions.

  • We reserve the right to issue refunds on a case-by-case basis (e.g., technical issues preventing delivery). Contact coachleoyoung@icloud.com with any refund requests.

7. Changes to Services, Pricing, Privacy Policy, and Terms We may modify, suspend, or discontinue any service, content, or pricing at any time without notice. We may update these Terms and the Privacy Policy at any time. Changes will be posted on the Site with an updated date. Continued use after changes constitutes acceptance.

8. Limitation of Liability To the fullest extent permitted by law, Lupos Baseball LLC, Coach Leo Young, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or services. Our total liability shall not exceed the amount you paid us in the 12 months prior to any claim. You assume all risks associated with physical training.

9. Dispute Resolution – Arbitration & Class Action Waiver Any dispute arising from these Terms shall be resolved through binding arbitration in Pinellas County, Florida, under the rules of the American Arbitration Association (AAA), instead of court. You waive any right to participate in a class action lawsuit or class-wide arbitration.

10. Governing Law These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any non-arbitrated claims shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida.
